SERVAL SHOULD NOT BE RELIED UPON IN AN EMERGENCY because, quite simply, it doesn’t always work. There are many reasons for this, some of which are explored below.

Serval is an INCOMPLETE PROTOTYPE software, experimental in nature and is not to be considered fit for merchantability for any purpose.  It almost certainly has many defects, omissions and errors that will hamper its fulfilling of its intended purposes.

Serval software comes with no warranty.

Serval is BEST EFFORT in nature.  This is very different to communications systems you may be accustomed to, and particularly with the cellular communications networks for which mobile telephones are primarily intended.  The cellular network attempts to provide certain guarantees and standards of service, which it can do so because the cellular network operators have invested in and operate extensive supporting infrastructure and dedicated spectrum.  In contrast, Serval is a means by which individual devices gain the possibility to form local communications networks, possibly without the support of infrastructure. Possibility should not be construed to mean guaranteed or reliable ability.

The resulting system is in fact dependent on the devices which each user independently controls.  Serval has no control over these devices, and thus cannot guarantee anything about the resulting service or lack there of.  Moreover, Serval adapts capabilities of mobile phones and other devices which were never intended to operate in the manner in which Serval applies them. Also, Serval does not make use of dedicated spectrum, and is limited to very low transmission power levels, such that actions by third parties may prevent the effective operation of Serval at any place or at any time.  For these any other reasons, the proper mindset for the use of Serval is to assume that it will not work, but then be pleasantly surprised if it does happen to work in any instance.  Thus, Serval should not be relied upon in place of any other communications capability which it may or may not have the possibility to substitute for in function, in whole or in part. SERVAL SHOULD NOT BE RELIED UPON IN AN EMERGENCY.

Serval MAY FAIL TO OPERATE, for reasons including but not limited to those described elsewhere in this disclaimer. If the proper operation of Serval is relied upon at any time this has the potential to cause harm to those involved.

Serval and the persons and corporations creating and assisting in the creation and refinement of Serval hereby assert that they are operating as technological GOOD SAMARITANS, taking preparatory actions which are performed in the hope that they will help others in the future, without hope of compensation, and without discrimination or distinction, with the support of the Universal Declarations of Human Rights which these interpret communications as being a human right with a positive obligation on civil society to provide.

Serval may REVEAL AND/OR BROADCAST YOUR LOCATION, IDENTITY OR OTHER INFORMATION in its normal operation or potentially due to fault or defect in the systems, protocols, software and other components of which it consists.  While in some cases Serval takes steps, and expects to continue to take further steps to minimise this the prototype software lacks sufficient protections as might be reasonably expected in this type of system.  This is partly because the system is a prototype and incomplete, and partly the nature of the system.

Serval may permanently alter or damage the software or hardware on devices upon which it is installed.

You choose to use Serval at your sole risk and indemnify Serval from any damages, direct or indirect, no matter the form or cause that may result from your use of, or inability to use Serval, or from the effect that Serval has on your ability to perform other functions.
